The Maricopa County Air Quality Department will kick off its Permit Amnesty Program effective September 15, 2009. This initiative, proposed for a three month time frame, will allow unpermitted sources in Maricopa County to apply for and obtain an air quality permit. This gives a company the opportunity to come into compliance with air quality regulations without being subject to penalties for operating without a permit.
“With Maricopa County designated in serious non-attainment for particulate matter and with monitoring now showing non-attainment for ozone levels, it is important that every facility emitting air pollutants be operating under a permit and participating in reducing emissions,” states Lawrence Odle, director of the Maricopa County Air Quality Department.
During September 15, 2009 through December 15, 2009, facilities can apply for an air quality permit(s) without facing the penalties for previously operating without one. The Permit Amnesty Program will exclude dust control permits required under Rule 310, Fugitive Dust from Dust-Generating Operations as well as large Title V sources. After the expiration of the amnesty monetary penalties will be reassessed for unpermitted sources.
“The incentive for offering the Permit Amnesty Program is the threat of being penalized for operating without a permit is temporarily waived,” commented Odle. “The amnesty allows a window of opportunity for businesses to do the right thing and apply for an air quality permit.”
