Public Records Requests

In Maricopa County, each department handles its own records. The Office of the Clerk of the Board maintains records related to Board of Supervisors and Boards of Directors of countywide district actions and related documents. Such records are available for public inspection in the Clerk’s Office during regular business hours.

The Clerk of the Board charges for records provided in a tangible format, pursuant to A.R.S. § 39-121.01 (D)(1). Additional costs may be charged for commercial purposes. In general, the Clerk’s Office charges:

  • 25 cents per paper page
  • $5.00 for a CD/DVD

Non-Commercial Use Form

WARNING: Arizona Revised Statutes §39-121.03(C) provides: A person who obtains public records for commercial purpose without indicating the commercial purpose or who obtains a public record for a non-commercial purpose and uses or knowingly allows the uses of such public record for a commercial purpose or who obtains a public record for a commercial purpose and uses or knowingly allows the use of such public record for a different commercial purpose shall in addition to other penalties be liable to the state or the political subdivision from which the public record was obtained for damages in the amount of three times the amount which would have been charged for the public record had the commercial purpose been stated plus costs and reasonable attorney’s fees or shall be liable to the state or political subdivision for the amount of three times the actual damages if it can be shown that the public record would have not been provided had the commercial purpose of actual use been stated at the time of obtaining the records.

In accordance with A.R.S § 39-121.03 (D), commercial uses include:

  • Use of the public records for sale or resale;
  • Obtaining names and addresses from public records for the purposes of solicitation; and
  • The sale of names and addresses to another for any purpose in which the purchaser can reasonably anticipate the receipt of monetary gain from the direct or indirect use of the public record.

Commercial purpose does not include

  • The use of a public record as evidence or as research for evidence in an action in any judicial or quasi-judicial body;
  • The use of public records for one’s trade or business; or
  • Gathering newsworthy facts from public records to include in a newspaper or other publication.
