FORMATION AUTHORITY: The Authority was established by the Board of Supervisors on May 21, 2003, pursuant to A.R.S. § 36-1404
COMPOSITION: Bylaws, Article II: The Authority shall be governed by a seven member Board of Commissioners. No Commissioner may hold an office or be an employee of the County or of a city or town in Maricopa County. Each member of the Board of Supervisors shall appoint one Commissioner. The Chief Administrative Officer of the County shall recommend a sixth Commissioner, subject to the approval of the Board of Supervisors. The Board of Supervisors shall by majority vote appoint a seventh commissioner who must be a resident in good standing of a housing project financed or operated by the Authority. The Board of Commissioners shall initially serve staggered terms as determined by the Board of Supervisors. Thereafter, members shall be appointed to four year terms. Vacancies shall be filled for the unexpired portion of the term. A Commissioner may be removed by the Board of Supervisors for inefficiency, neglect of duty or misconduct in office, as specified in A.R.S. § 36-1405.
DUTIES AND POWERS: Bylaws, Article III: The Board of Supervisors shall designate a Chairman and Vice-Chairman from among the Commissioners. The Authority shall recommend, with approval from the Chief Administrative Officer, a Secretary who is not a member of the Authority. The Secretary shall also serve as Treasurer. In conformity with Section 5.3, Intergovernmental Agreement, the Housing Authority shall: Provide affordable housing to low-income Maricopa County residents, at rents fixed no higher than necessary to produce sufficient revenue; pay due principal and interest on bonds and other borrowings; meet costs of maintaining and operating housing projects and providing related support services for tenants; to create and maintain, during not less than six years immediately succeeding the issuance of any bonds, a reserve sufficient to meet the largest principal and interest payments that will be due on the bonds in any year thereafter; Shall procure and maintain errors and omissions, public liability, property damage, workmen's compensation, group health, life, and disability insurance coverage through County Risk Management or gain approval by County of types and levels of coverage through a different carrier; shall make available its books and records for audit and conduct an annual audit of finances as required by the U.S. Dept. of Housing and Urban Development. The Authority may amend the Bylaws, provided that notice shall be give to the CAO no later that 30 days prior to amending the bylaws. Per section 7.3, Intergovernmental Agreement, at any time the Housing Authority may be dissolved and the IGA terminated at the sole and absolute discretion of the County, upon written notice to the Housing Authority. 7.4, Upon dissolution, all assets of the Housing Authority (after paying for expenses of Authority) shall be transferred to the County. All meetings of the Board of Commissioners of the Authority shall be subject to the Arizona Open Meeting Law.
